A Blairgowrie fruit company accused of breaches of Health & Safety laws that led to a workers death has had trial put back until later this year.

Thomas Thomson, director of Thomas Thomson (Blairgowrie) Ltd, Brambleban Works, Haugh Road, was in court as his solicitor explained he was not yet ready to proceed with the trial, originally scheduled for March 23.
The company denies that between July 1 and 28, 2006, it failed to provide instruction, training and supervision necessary to ensure the safety of its employees working on the erection, covering, dismantling and maintenance of polytunnels there.
It also denies that workers were not made aware of the risks of electrical dangers there and of the precautions to be observed.
The charges allege that Gerard Faltynowski (26), of Swidwyn, Poland, brought a metal structure into contact with an 11kV overhead power line and was fatally electrocuted on July 28, 2006, at Mains of Rattray Farm, Blairgowrie.
The charges have been brought against Mr Thomson personally, as well as against his company.
The company further denies that it allowed four people, including Mr Faltynowski, to work near a live conductor that was not suitably covered with insulating material to prevent danger.
The trial will now take place on May 26 |
